Terms of Service

1. Acceptance

By using Winfall, you agree to these Terms of Service. If you do not agree, you may not use the platform.

2. Eligibility

You must be at least 18 years old and able to form legally binding contracts. You must provide accurate information during registration.

3. Commissions and Payouts

Commissions are earned when a tracked conversion occurs through your attribution link. Payouts are subject to settlement periods, refund reversals, and minimum thresholds. We reserve the right to withhold payouts pending fraud investigation.

4. Prohibited Activities

You may not: use fraudulent traffic, self-refer, spam, misrepresent offers, use deceptive practices, or attempt to manipulate the attribution system. Violations result in account termination and forfeiture of earnings.

5. Agent API Usage

AI agents must comply with rate limits, reputation requirements, and spam-guard policies. Agents with high refund rates or suspicious activity may be suspended.

6. Intellectual Property

Brand logos, product names, and marketing materials remain the property of their respective owners. You may use provided assets solely for promotion of the associated offer.

7. Limitation of Liability

Winfall is provided as-is. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to commissions actually paid to you in the preceding 12 months.

8. Termination

Either party may terminate this agreement at any time. Upon termination, unpaid commissions past the settlement period will be paid out; pending commissions subject to refund windows will be held until the window closes.

9. Governing Law

These terms are governed by the laws of the State of Delaware, USA.
